Terms & Conditions
1. Acceptance of Terms
By enrolling a swimmer with The Swim Society, you agree to be bound by these Terms & Conditions. These Terms apply to all swimmers, parents, guardians, and caregivers attending our programmes.
2. Enrolment
- Enrolments are accepted subject to availability.
- Parents and guardians are responsible for ensuring all enrolment information is accurate and up to date, including medical conditions, emergency contacts, and any additional support requirements.
- The Swim Society reserves the right to refuse or cancel enrolment where it is deemed necessary for the safety or wellbeing of swimmers, staff, or other participants.
3. Class Placement
Parents will select the class level they believe is most suitable for their swimmer at the time of enrolment. All swimmers will be assessed by their instructor during their first lesson. The Swim Society reserves the right to move swimmers to a different class level where appropriate to ensure the best learning experience and safety of all participants.
4. Fees and Payment
- Invoices are issued prior to the commencement of each term.
- Payment must be made by bank transfer by the due date stated on the invoice.
- Failure to make payment by the due date may result in suspension of lessons, loss of the swimmer's place, or additional administration fees.
- Outstanding accounts may be referred to a debt collection agency. Any collection costs incurred may be charged to the account holder.
5. Refund Policy
Fees are non-refundable once a term has commenced. Refunds will not be provided for missed lessons, holidays, family commitments, sporting events, change of mind, or illness/injury. Exceptions may be considered at the sole discretion of The Swim Society in cases of long-term illness, serious injury, or exceptional circumstances.
6. Missed Lessons and Make-Up Lessons
A swimmer may be eligible for one make-up lesson per term due to illness, subject to availability. Notice must be provided before the scheduled lesson where possible. Make-up lessons are not guaranteed, cannot be carried forward, and have no cash value.
7. Cancellation by The Swim Society
If The Swim Society cancels a lesson due to instructor illness, pool closure, facility issues, or extreme weather, a make-up lesson, credit, or alternative arrangement may be offered at our discretion.
8. Attendance and Punctuality
Swimmers should arrive ready to swim at least 5 minutes before their lesson. Lessons will finish at their scheduled time regardless of late arrival. Missed lesson time due to lateness cannot be made up.
9. Parent and Caregiver Responsibilities
- Parents and caregivers remain responsible for their children before and after lessons.
- Children must be supervised at all times.
- Only parents or caregivers enrolled in baby classes may enter the water unless otherwise authorised.
- All directions given by instructors must be followed.
10. Health and Safety
Participants must not attend if they have vomiting/diarrhoea within 48 hours, contagious illnesses, or open wounds. The Swim Society must be notified of any medical condition or support requirement.
11. Behaviour Expectations
All participants are expected to behave respectfully. Aggressive or inappropriate behavior will not be tolerated. We reserve the right to terminate enrolments without refund where behavior compromises safety.
12. Additional Needs
We welcome swimmers of all abilities. Parents must provide information regarding support requirements so we can safely meet the swimmer's needs. Suitability of instructors or programmes cannot be guaranteed for every individual.
13. Photography and Media
Photographs or videos may be taken for promotional purposes. Parents may opt out in writing. Filming of other children is strictly prohibited without prior consent.
14. Personal Property
The Swim Society accepts no responsibility for loss, theft, or damage to personal belongings. All items are brought onto the premises at the owner's risk.
15. Limitation of Liability
Swimming involves inherent risks. Participation is at the swimmer's own risk. To the fullest extent permitted by NZ law, we shall not be liable for injury or loss except where caused by our negligence.
16. Emergency Medical Treatment
In an emergency, we may seek medical treatment for a swimmer if parents cannot be reached. Associated costs remain the parent's responsibility.
17. Programme Changes
We reserve the right to change instructors, adjust class times, or modify programmes where necessary. Reasonable notice will be provided where possible.
18. Privacy
Information is handled in accordance with the Privacy Act 2020 and used only for purposes relating to enrolment, safety, and administration.
19. Force Majeure
The Swim Society shall not be liable for cancellations caused by events outside our control, including natural disasters, pandemics, or facility failures.
20. Amendments
We reserve the right to amend these Terms at any time. The most current version will be available on our website.
